Welcome to Lumium (the "Service"). Lumium is a social media application for storing and sharing personal memories through photos, videos, audio recordings, drawings, and text. By creating an account or otherwise using the Service, you agree to these Terms of Service (these "Terms"). If you do not agree, please do not use the Service.
You must be at least 13 years old (or the minimum age required to consent to data processing in your country) to use Lumium. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it current. You may not share your account or transfer it to another person without our permission.
You retain ownership of the memories, photos, videos, audio recordings, drawings, text, messages, and any other material you post or upload to Lumium (collectively, "User Content"). By submitting User Content, you grant Lumium a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display your User Content solely for the purpose of operating and improving the Service.
You are solely responsible for your User Content. You represent that you have all necessary rights to the content you upload and that it does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights. You agree not to upload content that you did not create or do not have permission to share.
You agree not to use Lumium to: (a) harass, abuse, or harm another person; (b) post content that is unlawful, defamatory, hateful, or infringing; (c) impersonate another person or misrepresent your affiliation; (d) send unsolicited messages or spam; (e) attempt to access another user's data without authorization; or (f) interfere with or disrupt the Service's operation.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including location data, contact details, and notification preferences. Please review the Privacy Policy for details.
The Lumium name, logo, software, and design are owned by Lumium and protected by intellectual property laws. These Terms do not grant you any right to use Lumium branding except as necessary to access the Service.
Lumium uses third-party services such as mapping, geocoding, and authentication providers to deliver certain features. These services have their own terms and may collect data as described in our Privacy Policy. We are not responsible for the practices of third-party providers.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that your memories will be preserved without loss. You are encouraged to keep your own backups of important content.
To the fullest extent permitted by law, Lumium shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the prior twelve months.
You may delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we believe your activity poses a risk to the Service or other users.
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other means. Your continued use after changes take effect constitutes acceptance of the revised Terms.
